Calabar Company Gets IGP’s Approval For Mandamus- Says Petitioner

COURT IN CALABAR ISSUES A MANDAMUS TO IGP TO RETURN EARTH MOVING EQUIPMENT THAT WERE WRONGFULLY TAKEN AND HANDED OVER TO A LEBANESE AS IGP ORDERS THE AUTHENTICATION OF THE MANDAMUS, RULING AND ORDER FROM THE COURT

A court in Calabar has issued a mandamus over an earlier decision of a Magistrate Court in Calabar in MC/53c/2019 to the to the IGP to return earth moving equipment that were wrongfully taken and given to a Lebanese man.

The said Lebanese man among others was taken to Court by a Nigerian business woman residing in Calabar in HC/430/2017 for trying to pay for her existing contract in a breech of contract suit. The Lebanese man rather hired a SAN who interpreted the business woman’s judgment in an earlier suit as binding upon himself and any other person, admitting to being privy of the initial owner and contractor Macmahon Nig Ltd. The Lebanese denial and admission of the woman’s judgment in suit HC/221/2017 which gave her EXCLUSIVE RIGHTS over the equipment.

The Lebanese man pleaded with the Court in HC/430/2017 to dismiss her claim for a breech of contract as it will amount to double compensation to her. The Court held that the woman is the one vested with authority to sell the said equipment and that the Lebanese has NOT PAID FOR THE EQUIPMENT and WILL NEVER PAY FOR HER EQUIPMENT, hence her claim for a breech was dismissed. This came four months after the Lebanese man made calls to the Business woman asking to give her monitory compensation to let go her contract for him.

The Lebanese man then hired some policemen from the IGP MONITORING UNIT who arrested the woman and some members of her family and a neighbor for two weeks while carrying the earth moving equipment at gun point with four pickup full of policemen at calabar.
Incidentally this took place two days after the Lebanese changed his business name and used an unregistered name to sue for an interpleader and lost same on the 4th of February 2019.
An application by the business woman’s lawyer to CAC has proven that the Lebanese went to Court with an unregistered name in order to rob the woman of justice which he lost. Finally the said ruling on MC/53c/2019 And its accompanying order was brought to the notice of the IGP after four years of trying to get it through.

The IGP has ordered for the authentication of the mandamus in HC/MSC/236/2021 and the decision of the Court on MC/53c/2019 which the mandamus is based on.

This newspaper was told by the petitioner that indeed the IGP gave the stayed instructions.
